Commercial Real Estate Transactions and Construction

We help businesses and individuals with commercial real estate leasing, construction, development, purchases and sales, financing, and management. We represent builders, developers, general contractors, subcontractors, real estate agents and brokers in all aspects of land use and development, zoning matters, lease or purchase agreement negotiation and drafting, and real estate-related litigation and arbitration. Our attorneys regularly represent owners and contractors in construction-related contract negotiations, litigation, and regulatory matters.

Business Formation and Contracts

We counsel and assist entrepreneurs and businesses with business structuring and entity formation, transfers of assets and business interests, and contract counsel, negotiation and drafting.

Commercial, Business, and Real Estate Litigation

We represent individuals and corporations in a wide variety of business-related litigation, including contract, banking, trust, insurance, and accounting disputes, competition and intellectual property litigation, and fraud and fraudulent conveyance claims. We routinely work with experienced forensic, accounting, technology and industry experts where appropriate.

We represent clients in all levels of courtroom, appellate, and arbitration advocacy, and litigate cases in all southern Arizona counties, in the federal district and bankruptcy courts in Tucson and Phoenix, and, with local counsel, in state and federal courts throughout the country. Our attorneys have taught trial advocacy and regularly serve as pro tem judges, arbitrators, and mediators. We bring the experience and perspective gained as fact finders to our role as counselors and litigation advocates.

Land Use & Development

We represent clients with matters before legislative bodies and government agencies, such as the Tucson Mayor and Council, the Pima County Board of Supervisors, local Developmental Services Departments, the Board of Adjustments, and the Arizona Registrar of Contractors.

Unfair Competition

We counsel and litigate for our clients in matters relating to trade secrets, non-solicitation and non-competition agreements, and claims of unfair competition. We routinely negotiate settlements in such cases, or litigate injunction and damage suits to verdict, as each case may require.

Class Actions

We have experience in consumer and business class action cases, and have written and lectured as panelists on the law in this area. We have defended corporations in such matters and have also represented plaintiff classes when individuals or other attorneys have sought our expertise and assistance with meritorious cases. Our experience provides unique insight that serves our client’s interests well, whether they are prosecuting or defending a class action suit.

Appeals

We represent clients and assist other attorneys in drafting briefs and arguing appeals. We have argued cases before appellate courts in Arizona and New York, and in the Eighth and Ninth Federal Circuits.

Arbitration and Alternative Dispute Resolution

We represent clients with matters before various arbitration panels, including the American Arbitration Association (AAA) and private arbitrators and arbitration panels created by contract. We are versed in all aspects of alternative dispute resolution, and employ mediation and other facilitated settlement processes where appropriate. We have experience serving as court-appointed and contractual arbitrators and mediators, and are available for retention for these services.
